PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS WEBSITE OR SUBSCRIBING TO OUR SERVICES. BY ACCESSING OR USING RAWOLOGYPETS.COM, CREATING AN ACCOUNT, OR PLACING AN ORDER, YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS. IF YOU DO NOT AGREE, PLEASE DISCONTINUE USE OF THIS WEBSITE IMMEDIATELY.

1. Introduction and Acceptance of Terms

These Terms and Conditions ("Terms," "T&C," or "Agreement") constitute a legally binding agreement between you ("Customer," "Member," "you," or "your") and RawOlogy Pet Food ("RawOlogy," "Company," "we," "us," or "our"), the owner and operator of the website located at RawOlogypets.com (the "Site").

These Terms govern your access to and use of the Site, including your registration for a subscription account, your purchase of products and services, your participation in any promotions or discount programs, and all interactions you have with us online or in connection with your subscription.

By accessing the Site, creating an account, or subscribing to any of our services, you represent that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, our Accessibility Statement, and our Shipping and Delivery Policy, each of which is incorporated herein by reference.

2. Eligibility and Permitted Use

To register for an account or subscribe to our services, you must:

Be at least 18 years of age, or the age of legal majority in your jurisdiction if higher
Be a legal resident of or located within our local service area
Have the legal capacity to enter into binding contracts
Not be prohibited from using our services under applicable federal, state, or local law

By registering, you represent and warrant that you meet all eligibility requirements. RawOlogy Pet Food reserves the right to refuse service, terminate accounts, or cancel orders at our sole discretion, including where we believe eligibility requirements have not been met.

The Site is intended for personal, non-commercial use. You may not use the Site or our services for resale, unauthorized data collection, or any purpose that violates applicable law or these Terms.

3. Account Registration and Security

3.1 Account Creation

To access subscription services and place orders, you must create an account on our Site. You agree to provide accurate, current, and complete information during registration and to keep your account information updated at all times.

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials, including your username and password. You agree to notify us immediately of any unauthorized access to or use of your account. RawOlogy is not liable for any loss or damage resulting from your failure to maintain account security.

3.3 One Account Per Customer

Each customer may maintain only one active account. Creating multiple accounts to circumvent subscription limits, obtain duplicate discounts, or for any other unauthorized purpose is prohibited and may result in immediate account termination.

4. Subscription Services

4.1 Nature of Subscription

RawOlogy Pet Food offers subscription-based plans through which customers receive recurring orders of raw pet food products on a schedule selected at the time of sign-up. By enrolling in a subscription plan, you authorize us to process recurring charges to your selected payment method in accordance with your chosen plan and these Terms.

4.2 Subscription Plans

Subscription plans, pricing, available products, and delivery or pickup schedules are described on the Site and are subject to change. We will provide reasonable advance notice of material changes to active subscription plans.

4.3 Subscription Modifications

You may modify your subscription plan including changes to product selections, quantities, or fulfillment frequency through your online account or by contacting us through our Contact Page. Modifications must be submitted prior to the cutoff date communicated for your next order cycle.

4.4 Subscription Pause

We may offer the ability to pause your subscription for a defined period. Pause availability, duration limits, and any applicable conditions will be communicated through your account portal. Requests to pause must be made before the order processing cutoff for the applicable cycle.

4.5 Subscription Cancellation

You may cancel your subscription at any time through your account settings or by contacting us. Cancellations must be submitted before the processing cutoff for your next scheduled order to avoid being charged for that cycle. Cancellations received after the cutoff will take effect for the following order period. We do not offer refunds for subscription cycles that have already been processed unless required by applicable law.

4.6 Our Right to Modify or Discontinue Services

RawOlogy Pet Food reserves the right, at any time and without liability, to modify, suspend, or discontinue any aspect of the Site or subscription services including available products, pricing, fulfillment options, and plan structures with or without prior notice. We will make reasonable efforts to notify active subscribers of material changes affecting their existing plans. Your continued use of the subscription following any modification constitutes acceptance of the revised terms.

5. Pricing, Payment, and Billing

5.1 Pricing

All prices are listed in U.S. dollars and are subject to change. Prices displayed at the time of your order confirmation are the prices that will be charged for that order. We reserve the right to adjust pricing for future subscription cycles with reasonable advance notice to active subscribers.

5.2 Accepted Payment Methods

We accept the following payment methods, as made available on the Site from time to time:

Major credit cards (Visa, Mastercard, American Express, Discover)
Debit cards with a major card network logo
Digital payment platforms (such as Apple Pay or Google Pay, where enabled)
Such other payment methods as we may introduce at our discretion

Payment is processed securely through our third-party payment processor. We do not store full payment card numbers on our servers. By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge it for all amounts due.

5.3 Recurring Billing Authorization

By subscribing, you expressly authorize RawOlogy to charge your selected payment method on a recurring basis according to your subscription plan. Charges will be processed prior to each order fulfillment cycle. It is your responsibility to ensure your payment information remains current and valid.

5.4 Failed Payments

If a payment fails, we will attempt to notify you and may retry the charge. If payment cannot be collected after reasonable attempts, we reserve the right to suspend or cancel your subscription until the outstanding balance is resolved.

5.5 Taxes

Applicable sales tax or other taxes may be added to your order total as required by law. Tax amounts are calculated based on your order pickup or delivery location and applicable tax rates at the time of purchase.

6. Discounts, Promotions, and Special Offers

6.1 Promotional Offers

RawOlogy Pet Food may, from time to time and at its sole discretion, offer discounts, promotional pricing, referral credits, introductory rates, or other special offers ("Promotions"). Promotions are subject to availability and may be withdrawn or modified at any time without notice.

6.2 Eligibility for Promotions

Promotional offers may be subject to eligibility requirements, including but not limited to: new subscriber status, minimum purchase thresholds, specific product selections, or geographic restrictions. Unless expressly stated, Promotions are non-transferable, have no cash value, and may not be combined with other offers.

6.3 Discount Codes

Discount codes, where offered, must be applied at the time of checkout. Codes cannot be applied retroactively to completed orders. RawOlogy reserves the right to refuse or revoke discount codes that are used in violation of these Terms or obtained through unauthorized means.

6.4 Modification or Termination of Promotions

We reserve the right to modify, suspend, or terminate any Promotion at any time at our sole discretion. Participation in a Promotion does not create any entitlement to continued discounted pricing or future promotional offers.

7. Order Fulfillment and Delivery

All orders are fulfilled through in-store pickup or local delivery services as described in our Shipping and Delivery Policy, which is incorporated into these Terms by reference. We do not offer national or general parcel shipping.

We reserve the right to refuse, limit, or cancel orders at our discretion, including where we suspect fraud, abuse of promotional offers, or violations of these Terms. If we cancel a valid order, we will issue a full refund for the affected order.

8. Refunds and Returns

8.1 Perishable Products

Due to the perishable nature of raw pet food, we are unable to accept returns of food products once they have been picked up or delivered. All sales of food products are final unless the product is defective, spoiled at the time of receipt, or incorrectly fulfilled.

8.2 Defective or Incorrect Orders

If you receive a product that is spoiled, damaged, or incorrect, please contact us within 24 hours of pickup or delivery through our Contact Page. We will investigate and, at our discretion, issue a replacement, store credit, or refund for the affected items.

8.3 Subscription Refunds

Subscription fees that have been processed are generally non-refundable unless cancellation was requested prior to the applicable order processing cutoff or as otherwise required by Florida law.

9. Intellectual Property and Copyright

9.1 Ownership

All content on the Site, including but not limited to text, graphics, logos, images, product descriptions, videos, icons, software, and the overall design and compilation of the Site (collectively, "Content") is the exclusive property of RawOlogy Pet Food or its licensors and is protected by United States and international copyright, trademark, trade dress, and other intellectual property laws.

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and its Content solely for your personal, non-commercial use in connection with our services. This license does not include the right to download, copy, reproduce, republish, upload, post, transmit, scrape, or distribute any Content without our prior written consent.

9.3 Trademarks

The RawOlogy Pet Food name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of RawOlogy Pet Food. You may not use these marks without our prior written permission. All other names, logos, and marks are the trademarks of their respective owners.

9.4 User-Submitted Content

If you submit reviews, photos, feedback, or other content to the Site or our social media platforms, you grant RawOlogy a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, publish, and display that content in connection with our business and marketing activities. You represent that you own or have the right to submit such content and that it does not infringe any third-party rights.

10. Prohibited Conduct

You agree that you will not use the Site or our services to:

Violate any applicable federal, state, or local law or regulation
Infringe upon the intellectual property rights of RawOlogy or any third party
Submit false, misleading, or fraudulent information
Attempt to gain unauthorized access to any part of the Site, our systems, or other users' accounts
Use automated tools, bots, scrapers, or similar technologies to access or extract data from the Site without our prior written consent
Engage in any conduct that disrupts or interferes with the Site's functionality or other users' access
Use our services for resale or commercial purposes without our express written authorization
Abuse promotional offers, create duplicate accounts, or exploit discount programs in bad faith

Violation of this section may result in immediate account suspension or termination, cancellation of orders, and, where applicable, legal action.

11. Account Suspension and Termination

11.1 By RawOlogy

RawOlogy Pet Food reserves the right to suspend, restrict, or permanently terminate your account and access to the Site at any time, with or without notice, for any reason, including but not limited to: violation of these Terms, fraudulent activity, repeated failed payments, abuse of Promotions, or conduct that we determine, in our sole discretion, to be harmful to the Company, other customers, or the public.

11.2 Effect of Termination

Upon termination of your account, your right to access the Site and use our services will immediately cease. Any outstanding charges due at the time of termination remain payable. Provisions of these Terms that by their nature should survive termination — including intellectual property rights, disclaimers, limitations of liability, and governing law — will survive.

11.3 By You

You may close your account at any time by contacting us through our Contact Page. Closing your account constitutes cancellation of any active subscription, subject to the cancellation terms in Section 4.5.

12. Disclaimers and Warranties

12.1 No Veterinary or Medical Advice

The information provided on the Site, including product descriptions and nutritional information, is for general informational purposes only and does not constitute veterinary or medical advice. Always consult a licensed veterinarian before making changes to your pet's diet, particularly if your pet has a health condition.

12.2 Disclaimer of Warranties

THE SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. RAWOLOGY PET FOOD DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12.3 Product Representations

We make reasonable efforts to accurately describe our products on the Site. However, we do not warrant that product descriptions, images, or other content are complete, accurate, or current. Product availability is subject to change without notice.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RAWOLOGY PET FOOD AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE OR OUR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO RAWOLOGY PET FOOD IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. In such jurisdictions, our liability will be limited to the fullest extent permitted by law.

14. Indemnification

You agree to defend, indemnify, and hold harmless RawOlogy Pet Food and its owners, officers, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your use of the Site or services; (c) your submission of any content; or (d) your violation of any third-party right, including any intellectual property right or privacy right.

15. Third-Party Links and Services

The Site may contain links to third-party websites, platforms, or services (including delivery platforms such as Uber Eats or DoorDash). These links are provided for convenience only. RawOlogy does not endorse, control, or assume responsibility for the content, privacy practices, or terms of any third-party services. Your use of third-party services is at your own risk and subject to the applicable third party's terms and policies.

16. Privacy

Your use of the Site is also governed by our Privacy Policy, which is available at RawOlogypets.com and incorporated into these Terms by reference. By using the Site, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.

17. Changes to These Terms

RawOlogy Pet Food reserves the right to revise these Terms at any time. When we make material changes, we will update the effective date at the top of this page and, where appropriate, provide additional notice (such as a notification in your account or by email). Your continued use of the Site or subscription services after the effective date of any revised Terms constitutes your acceptance of those changes.

We encourage you to review these Terms periodically. If you do not agree to a material change, you should cancel your subscription and discontinue use of the Site before the revised Terms take effect.

18. Governing Law, Jurisdiction, and Dispute Resolution

18.1 Governing Law

These Terms and any disputes arising out of or related to them, your use of the Site, or your subscription shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Where federal law applies, including under the ADA or applicable consumer protection statutes, such federal law shall govern.

18.2 Jurisdiction and Venue

You agree that any legal action or proceeding arising from or relating to these Terms shall be brought exclusively in the state or federal courts located in the State of Florida, and you hereby consent to the personal jurisdiction and venue of such courts.

18.3 Informal Resolution

Before initiating any legal action, you agree to contact us through our Contact Page and provide a written description of the dispute. We will attempt in good faith to resolve any dispute informally within thirty (30) days of receiving written notice. This informal resolution step is a condition precedent to any formal legal action.

18.4 Class Action Waiver

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND RAWOLOGY AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.

19. Severability and Waiver

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions will continue in full force and effect.

Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision unless acknowledged and agreed to by us in writing.

20. Entire Agreement

These Terms, together with our Privacy Policy, Accessibility Statement, and Shipping and Delivery Policy, constitute the entire agreement between you and RawOlogy Pet Food with respect to your use of the Site and our services, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the same subject matter.
